Glasgow's Fireworks Ordinance

Sec 14-14 Fireworks Revised

Definitions: Per 50-37-101 Montana Code Annotated. Fireworks defined.

The term “fireworks” means any combustible or explosive composition or any substance, combination of substances, or article prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration, or detonation and includes sky rockets, roman candles, daygo bombs, blank cartridges, toy cannons, toy canes, or toy guns in which explosives other than toy paper caps are used, the type of balloons which require fire underneath to propel them, firecrackers, torpedoes, sparklers or other fireworks of like construction, any fireworks containing any explosive or flammable compound, or any tablets or other device containing any explosive substance.

Permissible fireworks, excluding sky rockets, roman candles, and bottle rockets, include and are limited to those that meet the definition of “common fireworks” as set forth in the U.S. department of transportation’s Hazardous Materials Regulations, 49 CFR, parts 173.88 and 173.100, as they read on January 1, 1985, and that comply with the construction, chemical composition, and labeling regulations of the U.S. consumer product safety commission, as set forth in 16 CFR, part 1507, as it read on January 1, 1985.

(a) It shall be unlawful for any person to store, fire, set off, explode, or discharge of any firework within the city limits.

(b) It shall be unlawful for any individual, firm, partnership, cooperation, or association to possess fireworks for sale within the city limits.

Exceptions: The use of fireworks are prohibited within the city limits under the following terms and anyone who participates in this exception and/or allows fireworks on or near their property are liable for any garbage, fire, and/or projectiles associated with the fireworks.

From the period of June 24th- July 5th each year storage of fireworks will be allowed within the city limits.

From the period of July 3rd- July 5th each year, permissible fireworks can be fired, set off, exploded, or discharged with in the city limits, aerial projectile cannot exceed 10 feet in the air. (The purpose of this section is to include fountains, but not other aerial fireworks.) Fireworks shall be permitted between the hours of 12:30 PM and 12:30 AM only.

From the period of December 31st each year, permissible fireworks can be fired, set off, exploded, or discharged with in the city limits, aerial projectile cannot exceed 10 feet in the air. Fireworks shall be permitted between the hours of 12:30 PM and 12:30 AM only.

Violation/Fines: Anyone who violates any section of 14-14 is subject to fine and restitution for damages caused any garbage, fire, and/or projectiles associated with the fireworks.

Under this section 14-14 a person may be fined up to $100 for each violation of this section.

Penalties under MCA 50-37-120 may apply.
